Article 2 — Applicability

2.1 These terms and conditions apply to every offer made by OSH Gi Wear and to every agreement concluded between OSH Gi Wear and the customer.

2.2 Before an agreement is concluded, the customer is provided with these terms and conditions. If this is not reasonably possible, OSH Gi Wear will indicate how the terms and conditions can be viewed and that they will be sent free of charge upon request.

2.3 OSH Gi Wear reserves the right to amend these terms and conditions. Changes take effect from the date of publication on the website.

Article 3 — The offer

3.1 All offers on oshgiwear.com are without obligation and subject to availability.

3.2 OSH Gi Wear cannot be held to an offer if the customer should reasonably have understood that the offer, or any part thereof, contained an obvious mistake or error.

3.3 Each offer includes a clear description of the products offered. Images are an accurate representation of the products. Obvious errors or mistakes do not bind OSH Gi Wear.

3.4 All prices shown are inclusive of VAT and, unless otherwise stated, exclusive of shipping costs.

Article 4 — The agreement

4.1 The agreement is concluded at the moment the customer accepts the offer and meets the conditions set out therein.

4.2 OSH Gi Wear confirms receipt of acceptance of the offer electronically without delay. Until receipt of this confirmation, the customer may dissolve the agreement.

4.3 OSH Gi Wear reserves the right to assess whether the customer can meet the payment obligations and to refuse an order or attach special conditions to its execution.

4.4 OSH Gi Wear will send the following information with the product or electronically: the visiting address of OSH Gi Wear, the conditions under which the customer can make use of the right of withdrawal and information about after-sales service and guarantees.

Article 5 — Prices

5.1 Prices are in euros (€) and include VAT applicable in the Netherlands.

5.2 For deliveries outside the European Union, additional customs duties, taxes or levies may apply. These are entirely at the expense and responsibility of the customer. OSH Gi Wear has no influence over these costs and cannot predict their amount in advance.

5.3 Price increases between the time of order and delivery are not passed on to the customer, unless the price increase is the result of statutory regulations.

Article 6 — Payment

6.1 OSH Gi Wear accepts the following payment methods: iDEAL, Klarna (pay later), PayPal, Visa, Mastercard, American Express and SEPA bank transfer.

6.2 Payment must be made at the time of ordering, unless the customer makes use of Klarna's pay later option, in which case Klarna's own terms and conditions apply.

6.3 The customer is obliged to report inaccuracies in payment details provided or stated to OSH Gi Wear without delay.

6.4 In the event of non-payment by the customer, OSH Gi Wear has the right — subject to legal restrictions — to charge the reasonable costs made known in advance to the customer.

Article 7 — Delivery

7.1 OSH Gi Wear ships worldwide. Orders placed today are dispatched within 1–3 working days, regardless of destination.

7.2 Estimated delivery times by region:

• Netherlands and Belgium: 1–3 working days after dispatch
• Germany and France: 2–5 working days after dispatch
• Rest of Europe: 3–7 working days after dispatch
• Rest of the world: 7–21 working days after dispatch

7.3 Delivery times are indicative. OSH Gi Wear cannot be held liable for delays caused by the carrier or customs clearance.

7.4 OSH Gi Wear ships via PostNL. Track & trace information is provided upon dispatch.

7.5 If delivery of an ordered product is not possible, OSH Gi Wear will notify the customer within 30 days. In that case the customer is entitled to dissolve the agreement without costs and to receive a refund within 14 days.

7.6 The risk of loss or damage to products transfers to the customer at the moment of delivery.

Article 8 — Right of withdrawal

8.1 The customer has the right to dissolve the agreement within 14 days of receipt of the product without giving any reason.

8.2 The withdrawal period starts on the day after the customer, or a third party designated by the customer, receives the product.

8.3 Personalised products — shirts with a name, number, text or other custom element chosen by the customer — are excluded from the right of withdrawal under art. 6:230p sub f (1) of the Dutch Civil Code. Before adding a personalised product to the cart, the customer explicitly agrees to this exclusion.

8.4 To exercise the right of withdrawal, the customer must notify OSH Gi Wear within the withdrawal period via oshgiwear@gmail.com or using the model withdrawal form available on the returns page.

8.5 The full returns process, conditions and refund timeline are set out in the Returns Policy at oshgiwear.com/pages/returns, which forms an integral part of these terms and conditions.

Article 9 — Conformity and warranty

9.1 OSH Gi Wear guarantees that its products conform to the agreement, the specifications stated in the offer, the reasonable requirements of reliability and usability, and the statutory provisions in force on the date of the conclusion of the agreement.

9.2 A warranty arranged by OSH Gi Wear, manufacturer or importer does not affect the statutory rights and claims the customer can assert against OSH Gi Wear under the agreement.

9.3 Defects or incorrectly delivered products must be reported to OSH Gi Wear within 48 hours of delivery via oshgiwear@gmail.com, accompanied by the order number and clear photographs of the issue.

9.4 The following is explicitly not covered by warranty: damage resulting from improper use, failure to follow care instructions, or normal wear and tear.

Article 10 — Liability

10.1 OSH Gi Wear's liability for any attributable failure in the performance of the agreement is limited to the invoice value of the order, or at least to the part of the order to which the liability relates.

10.2 OSH Gi Wear is not liable for indirect damage, including consequential loss, lost profit, missed savings or damage to third parties.

10.3 The limitations of liability set out in this article do not apply if the damage is due to intent or gross negligence on the part of OSH Gi Wear.

Article 11 — Intellectual property

11.1 All intellectual property rights relating to the website, product designs, brand, logo, texts and images belong to OSH Gi Wear or its licensors.

11.2 Nothing on the website may be copied, reproduced, distributed or published without prior written consent from OSH Gi Wear.

11.3 OSH Gi Wear respects the intellectual property rights of third parties. If you believe that material on this website infringes your rights, please contact oshgiwear@gmail.com.

Article 12 — Personal data

12.1 OSH Gi Wear processes the personal data of customers in accordance with the General Data Protection Regulation (GDPR) and the Dutch Implementation Act (UAVG).

12.2 Personal data is used solely for processing orders, communicating with customers and complying with legal obligations.

12.3 OSH Gi Wear does not sell personal data to third parties. Data is only shared with carriers (PostNL) and payment providers (Klarna, PayPal, Shopify Payments) to the extent necessary to fulfil the order.

12.4 The customer has the right to access, correct and delete their personal data. Requests can be submitted to oshgiwear@gmail.com.

Article 13 — Complaints

13.1 Complaints about the execution of the agreement must be submitted to OSH Gi Wear within a reasonable time after the customer has discovered the defect, fully and clearly described, via oshgiwear@gmail.com.

13.2 OSH Gi Wear will respond to complaints received within 14 days of receipt. If a complaint requires a longer processing time, OSH Gi Wear will confirm receipt within 14 days and indicate when the customer can expect a more detailed response.

13.3 If a complaint cannot be resolved by mutual agreement, the customer may submit the dispute to the competent Dutch court.

Article 14 — Disputes and applicable law

14.1 All agreements between OSH Gi Wear and the customer are exclusively governed by Dutch law.

14.2 Disputes arising from the agreement will be submitted exclusively to the competent court in the district of Gelderland, the Netherlands, unless mandatory consumer law provisions designate another court.

14.3 The above does not affect the customer's right to submit a dispute to the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

Article 15 — Amendments

15.1 OSH Gi Wear reserves the right to amend these terms and conditions at any time. The most current version is always available at oshgiwear.com/pages/terms-and-conditions.

15.2 If an amendment affects the customer's rights under an existing agreement, the customer will be notified and given the option to dissolve the agreement free of charge.
